PAYDUNK, LLC MOBILE APPLICATION AND WEBSITE PRIVACY POLICY

This privacy policy governs your use of the software application Paydunk (“Application”) for mobile devices and our website at www.paydunk.com that was created by Paydunk, LLC.

User Provided Information

When you download and register the Application it obtains the information you provide. Registration is completely optional. However, without registration you may not be able to use some of the features offered by the Application unless registration is completed.

When you register with us and setup the Application, you will provide your mobile device phone number which will be used to identify you as an individual. To use the application you will have to load/provide other personal information such as; name, address(s), personal identification PIN number. And financial information such as; credit card number(s), expiration date(s) and Security Code(s). This information is immediately encrypted and stored locally on your mobile device where it remains private to only you.

From time to time we may contact you through SMS (text) or push notifications to provide you with important information, required notices and marketing promotions. Your email address will be required by most merchants to send you a receipt for your purchases/transactions. By providing the merchants/vendors this information you are agreeing to the terms and conditions of each of these indivuals sites. Paydunk will not collect your email unless you explicitly opt-in to our mailing list.

Automatically Collected Information

In addition, the Application may collect certain information automatically, including, but not limited to, the type of mobile device you use, your mobile devices unique device ID, the IP address of your mobile device, your mobile operating system, the type of mobile Internet browsers you use, and information about the way you use the Application.

Third Party Information

We will share your information with third parties only in the ways that are described in our privacy statement.

We may disclose User Provided and Automatically Collected Information: as required by law, such as to comply with a subpoena, or similar legal process; when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request; with our trusted services providers who work on our behalf, do not have an independent use of the information we disclose to them, and have agreed to adhere to the rules set forth in our privacy statement.

If Paydunk, LLC is involved in a merger, acquisition, or sale of all or a portion of its assets, you will be notified via email and/or a prominent notice on our Website of any change in ownership or uses of this information, as well as any choices you may have regarding this information.

Opt-Out Rights

You can stop all collection of information by the Application easily by uninstalling the Application. You may use the standard uninstall processes as may be available as part of your mobile device or via the mobile application marketplace or network.

We will retain User Provided data for as long as you use the Application and for a reasonable time thereafter. We will retain Automatically Collected information for up to 24 months and thereafter may store it in aggregate. If you’d like us to delete User Provided Data that you have provided via the Application, please contact us at info@paydunk.com and we will respond in a reasonable time. Please note that some or all of the User Provided Data may be required in order for the Application to function properly.

Children

We do not use the Application to knowingly solicit data from or market to children under the age of 18. If a parent or guardian becomes aware that his or her child has provided us with information without their consent, he or she should contact us at info@paydunk.com. We will delete such information from our files within a reasonable time.

Third Party Sites and Links

This Privacy Policy applies only to Paydunk. Paydunk may contain links to other web sites not operated or controlled by Paydunk (the “Third Party Sites”). The policies and procedures we described here do not apply to the Third Party Sites. The links from this Site do not imply that Paydunk endorses or has reviewed the Third Party Sites. We suggest contacting those sites directly for information on their privacy policies.

Social Media

Through Paydunk, you can choose to access certain social media websites and services that are owned and/or controlled by third parties (including, without limitation, Facebook and Twitter) (such websites and services, collectively, the “Social Media Services”). When you elect to access and use the Social Media Services, you will be sharing your information (which will include personal information if you elect to share such information) with those Social Media Services. As with other Third Party Sites, the information that you share with the Social Media Services will be governed by the privacy policies and terms of service of the providers of such Social Media Services and not by the polices and procedures we describe here. You may also be able to modify your privacy settings with these Social Media Services to, for example, control what information the Social Media Services disclose to other entities, including Paydunk. When you add Social Media Service accounts to Paydunk or log into Paydunk using your Social Media Services account, we will collect relevant information necessary to enable Paydunk to access that Social Media Service, however you will provide your login information, like your password, directly to such Social Media Service (and not to Paydunk). As part of such integration, the Social Media Service will provide Paydunk with access to certain information that you have provided to such Social Media Service, and we will use, store and disclose such information in accordance with this Privacy Policy and, if and to the extent applicable, the policies of such Social Media Services. However, please remember that the manner in which Social Media Services use, store and disclose your information is governed by the policies of the applicable Social Media Services provider, and, as a result, Paydunk shall not have any liability or responsibility for the privacy practices or other actions of Social Media Services that may be enabled within and/or otherwise accessible through Paydunk.
Security.

We are concerned about safeguarding the confidentiality of your information. We provide physical, electronic, and procedural safeguards to protect information we process and maintain. For example, we limit access to this information to authorized employees and contractors who need to know that information in order to operate, develop or improve our Application. Please be aware that, although we endeavor provide reasonable security for information we process and maintain, no security system can prevent all potential security breaches.

Changes

This Privacy Policy may be updated from time to time for any reason. The current privacy policy will be posted at: http://paydunk.com/privacy-policy/. You are advised to consult this Privacy Policy regularly for any changes, as continued use is deemed approval of all changes.

Consent

By using the Application, you are consenting to our processing of your information as set forth in this Privacy Policy now and as amended by us. “Processing,” means using cookies on a computer/hand held device or using or touching information in any way, including, but not limited to, collecting, storing, deleting, using, combining and disclosing information, all of which activities will take place in the United States. If you reside outside the United States your information will be transferred, processed and stored there under United States privacy standards.
